1. Contractual Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and CUP-TECH Limited ("we", "us", "our"), regarding your access to and use of the TryGetAm real estate platform, subdomain websites, and associated services (collectively, "the Platform").
By accessing, browsing, registering, or listing properties on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you are prohibited from using our services.
2. Onboarding, Registration, & Vetting
To list property assets, users must register as either an "Agent" or a "Direct Owner."
- Accuracy of Profiles: You agree to provide true, current, and complete information during registration. Real estate agencies are required to register corporate identities (e.g. CAC registration details).
- The Approvals Queue: To maintain platform trust and mitigate real estate fraud, new profiles are held in a secure Pending state. CUP-TECH Limited reserves the right to physically inspect listings, request identity verification documents, or conduct verification phone calls before activating accounts.
- Event Mode Bypass: During specific promotional campaigns, CUP-TECH Limited may toggle "Event Mode" to allow instant registration activation. We reserve the right to retroactively vet any profile activated during these events.
3. Listing Guidelines, Referrals, & Free Limits
Free tier trial accounts are subject to specific platform constraints designed to regulate listing health and incentivize premium subscriptions:
- The 3-Listing Free Cap: Upon registration, Free Trial accounts are entitled to publish up to 3 active property listings.
- The Signup Referral Bonus: You may invite other agencies or owners using your unique referral code. For every referred user who successfully registers a new account, you instantly unlock 2 additional free property listing slots on your account (no payment is required from the referred user for you to get this bonus).
- Media Upload limits: Each free listing is entitled to hold up to 5 high-resolution images (1 primary cover photo + up to 4 additional gallery images).
- The Edit-Lockout Paywall: Standard editing, modifying, or updating property details, pricing, locations, or images is strictly locked on the Free Trial tier. To unlock editing tools for *any* of their active listings, users must upgrade to a Paid Premium Subscription.
- Prohibited Content: Users may not list properties they do not own or have legal authority to broker, post duplicates, use false pricing, or upload graphic, offensive, or watermarked media.
4. Billing, Transactions, & Subscriptions
Subscription payments are integrated securely via Paystack.
- Pricing Adjustments: Subscription prices, package durations, and promotional settings are managed dynamically by our administrative console and may change upon operational review.
- Automatic Cancellations & Suspensions: If a premium subscription expires, associated additional listings will be hidden, and property editing tools will instantly lock until a payment renewal occurs.
- No-Refund Policy: All subscription charges are non-refundable. Once a plan is activated, digital access is immediately provisioned, and no prorated refunds will be offered for unused plan periods.
5. Moderation, Flagging, & Takedowns
To protect public buyers, the Platform includes a community flagging tool.
- Right to Moderate: CUP-TECH Limited reserves the absolute right to edit, modify, reject, or permanently delete any listing, image gallery, or account that is reported or discovered to violate local laws or platform standards.
- Immediate Suspension: If an agency or owner is reported for fraudulent activity, fake listings, or misleading communications, our compliance division reserves the right to immediately suspend their account, freeze their subdomain portal, and lock out their login.
6. Disclaimer of Warranties & Limitation of Liability
CUP-TECH Limited does not own, inspect, manage, or broker any of the properties listed on the Platform.
The Platform is provided strictly on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the safety, accuracy, legality, or availability of any listings.
Inspect Before Paying: We strongly advise all prospective buyers to perform rigorous physical inspections and involve qualified legal counsel before sending any funds to owners or agents. CUP-TECH Limited is NOT liable for financial loss, rental scams, property damage, or transactional disputes arising between platform users.
7. Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Federal Republic of Nigeria. Any legal action, dispute, or claim arising from these terms shall be settled exclusively in courts within Nigeria.
